The Services offered by Who’s Got Next Music encompass access to our website which details information about our company and services, alongside the provision to purchase products, listen to music, create playlists, and participate in voting. These Terms are applicable to all users of the Services, inclusive of those who contribute content, information, and other materials or services on the website.

Participants in the Who’s Got Next competition and voters in the app must be at least 18 years of age. Users below the age of 18 may utilize the Services for in-app spending, listening to music, creating playlists, and voting, granted they have the authorization of a parent or guardian. They are however restricted from entering the competition or any other sections of the Services designated for users aged 18 and above.

Engagement in harassment, discrimination, threat-making, or any other illegal or harmful activities through the Services is strictly prohibited. Usage of the content provided by the Services for unintended purposes is disallowed, as is the collection, solicitation, sale, or marketing of personal information of other users of the Services.

All content and materials provided by the Services, including but not limited to text, images, audio, and video, are protected under copyright, trademark, and other intellectual property laws, under an all-rights-reserved policy administered by Who’s Got Next Music to the fullest extent. Unauthorized use of any content or materials provided by the Services is strictly prohibited without our express written permission.

Purchasing Process: Upon deciding to purchase a product or service on our website, you will be prompted to provide billing and payment information. You hereby agree to pay all charges incurred by you or any users of your account and credit card (or other applicable payment mechanism) at the prices in effect when such charges are incurred, along with any applicable taxes.

Subscriptions: We offer open-ended subscriptions which will automatically renew unless cancelled prior to the end of the current billing cycle. Subscription cancellations can be done at any time and will take effect immediately at the end of the current billing cycle period.

In-App Advertising: Revenue may be generated through in-app third-party advertisements.

Right of Withdrawal: European consumers dissatisfied with a purchase have the right to withdraw from the contract within 14 days without providing a reason. The withdrawal period will expire 14 days from the day on which you, or a third party other than the carrier as indicated by you, acquires physical possession of the goods.

Amicable Dispute Resolution: For dispute resolution, we urge you to contact us directly at support@whosgotnextmusic.com. We endeavor to respond within 72 hours.

App Store: By downloading or using our app from the App Store, you assert that (a) you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.

User Generated Content: Users are responsible for the content they post on the app, with Who’s Got Next Music reserving the right to remove any content deemed objectionable within 24 hours.

Sponsorship Disclaimer: The contests or sweepstakes offered via the Services are not sponsored, endorsed, administered by, or associated with Apple Inc., Google Inc., or their subsidiaries or affiliates. Any inquiries, comments, or complaints regarding the contests or sweepstakes should be directed to Who’s Got Next Music, not Apple or Google.

Governing Law: These Terms shall be governed by and construed under the laws of the State of Georgia, United States, without giving effect to any principles of conflicts of law.

Disclaimers of Warranties: The Services are provided on an "as is" and "as available" basis without any warranties that the Services will be uninterrupted or error-free. Additionally, no representations or warranties regarding the accuracy, completeness, or reliability of any content available through the Services are made.

Limitations of Liability: We shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of the Services.

Indemnity: You agree to indemnify and hold harmless Who’s Got Next Music, its affiliates, officers, agents, and employees from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of the Services, your violation of these Terms, or your violation of any rights of another.
